TERMS AND CONDITIONS

1. About the Provider

This course is provided by:

For the purposes of these Terms, “we”, “us”, and “our” refer to the Provider.
“You” refers to the student purchasing the course.

2. Course Description

This is an online, self-paced professional education course designed to support individuals preparing for IBCLC certification.

The course includes:

  • Structured educational modules

  • End-of-module multiple choice assessments

  • Optional access to 3 IBCLC-style mock examinations

  • Lifetime access to course materials (subject to clause 11)

3. Important IBCLC Course Disclaimer

This course:

  • Is independently created.

  • The Lactation Consultant course is LEAARC Approved

  • It does not guarantee eligibility to sit the IBCLC examination.

  • Does not guarantee passing the IBCLC examination.

  • Does not guarantee certification or employment outcomes.

Students are solely responsible for confirming eligibility requirements directly with the certifying body IBCLE

4. Course Fee & Payment

4.1 Course Price

The total course fee for the Breastfeeding Counsellor Course is £750 GBP.
The total course fee for the Lactation Consultant (IBCLC) course is £997 GBP

4.2 Payment Options

Option A: Pay in Full

£750/£997 payable at checkout.

Option B: 3-Month Instalment Plan

3 equal monthly payments processed automatically via Stripe.

By choosing instalments, you:

  • Enter into a legally binding agreement to pay the full fee.

  • Authorise recurring automatic payments.

  • Acknowledge that this is not a subscription and cannot be cancelled once access has begun.

  • Remain liable for the full balance even if you stop using the course.

5. Missed or Failed Payments (Important)

If an instalment payment fails:

  1. Course access may be suspended immediately.

  2. You will be notified and given 7 days to remedy payment.

  3. Continued non-payment may result in:

    • Permanent removal of access

    • Withdrawal of lifetime access rights

    • Formal debt recovery action

    • Referral to a collections agency

    • County Court claim if necessary

All reasonable recovery costs may be added to the outstanding balance.

Failure to complete instalments does not cancel your contractual obligation.

6. 30-Day Cooling-Off Period

Under UK consumer law, you have 30 days from purchase to cancel.

However:

By accessing any digital course materials (including modules, assessments, or mock exams) during this period, you:

  • Expressly consent to immediate delivery of digital content.

  • Acknowledge that your statutory right to cancel is lost once access begins.

If no content has been accessed, a full refund will be issued upon written request within 30 days.

7. Refund Policy

Refunds are only available where:

  • Cancellation occurs within 30 days AND

  • No digital content has been accessed.

No refunds will be issued:

  • After course access begins.

  • After the 30-day period expires.

  • Due to exam failure.

  • Due to career change.

  • Due to workload or time constraints.

  • For instalment default.

  • For technical incompatibility on your side.

Exceptional circumstances (serious illness or bereavement) may be considered at our discretion.

8. Lifetime Access

“Lifetime access” means access for as long as the course platform and business continue to operate.

We reserve the right to:

  • Update content

  • Improve materials

  • Retire outdated modules

  • Close the course in the future (with reasonable notice)

Lifetime access does not create a perpetual legal obligation beyond the commercial lifespan of the course.

9. Intellectual Property

All materials are protected under the Copyright, Designs and Patents Act 1988.

You may not:

  • Share login details

  • Copy or distribute materials

  • Reproduce mock exam questions

  • Upload content to social media

  • Use materials to create your own training

Breach will result in immediate termination without refund and may result in legal action.

10. Academic Integrity

Students must complete assessments independently.

Sharing mock exam questions or reproducing assessment content is strictly prohibited.

11. Technical Requirements

You are responsible for:

  • Reliable internet access

  • Compatible devices

  • Personal cybersecurity

No refund will be provided for technical issues on your side.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Total liability shall not exceed £997.

  • We are not liable for indirect or consequential losses.

  • Nothing excludes liability for death or personal injury caused by negligence.

13. Complaints & Grievance Procedure

Step 1 – Informal Resolution

Response within 5 working days.

Step 2 – Formal Complaint

Submit written complaint including:

  • Full name

  • Date of enrolment

  • Nature of complaint

  • Evidence

  • Desired resolution

Response within 14 working days.

14. Data Protection & Privacy Policy

14.1 Data Controller

[Michelle Wilson], Sole Trader, is the Data Controller under the Data Protection Act 2018 and UK GDPR.

14.2 Data Collected

We may collect:

  • Name

  • Email

  • Billing address

  • Payment confirmation data (processed securely via Stripe)

  • Course progress data

  • Communication records

We do not store full payment card details.

14.3 Lawful Basis

Data is processed under:

  • Contractual necessity

  • Legal obligations (financial records)

  • Legitimate interests

  • Consent (where applicable)

14.4 Data Retention

  • Financial records retained for 6 years (HMRC compliance).

  • Course records retained while access remains active.

14.5 Your Rights

You may:

  • Request access

  • Request correction

  • Request erasure (where lawful)

  • Object to processing

  • Lodge a complaint with the ICO

15. Force Majeure

We are not liable for delays or interruption caused by events beyond reasonable control, including:

  • Platform outages

  • Illness

  • Regulatory changes

  • Technical failures beyond our control

16. Governing Law

These Terms are governed by the laws of England and Wales.

Disputes are subject to the jurisdiction of the courts of England and Wales.
