Introduction

• These Terms and Conditions ('Agreement') govern your participation in the LactationGO Affiliate Programme ('Programme'). LactationGO is operated by Michelle Wilson ('LactationGO', 'we', 'us', or 'our'), a company registered in England and Wales.

• By registering as an affiliate, you ('Affiliate', 'you', or 'your') agree to be bound by this Agreement in full. If you do not accept these terms, you must not participate in the Programme.

Eligibility

To participate in the Programme, you must:

• Be at least 18 years of age

• Have an active online presence (social media, website, email list, or professional network)

• Complete the affiliate application form truthfully and in full

• Receive confirmation of acceptance from LactationGO

• Not be a direct competitor offering IBCLC examination preparation courses 

• LactationGO reserves the right to accept or decline any application at its sole discretion, without obligation to provide reasons.

The Programme

Course Promoted

• The Programme covers promotion of LactationGO's Breastfeeding Counsellor course and Lactation Consultant (IBCLC) course(s) as listed on the LactationGO website at the time of your registration. LactationGO may add or remove products from the Programme at any time with reasonable notice.

Unique Affiliate Link

• Upon acceptance, you will be issued a unique tracking link ('Affiliate Link'). All referrals must be made using your Affiliate Link. Sales not made via your Affiliate Link will not qualify for commission.

Cookies & Tracking

• Your Affiliate Link uses a tracking cookie with a duration of 60 days from the date of a prospective student's first click. If a student completes enrolment within this window using your link, the sale will be attributed to you.

Commission

Rate

• You will earn a commission of 15% of the net sale price for each qualifying enrollment completed by a student who has reached the Course via your unique Affiliate Link. 

• 'Net sale price' means the amount actually paid by the student, after any discounts, promotional codes, or refund deductions, and excluding any applicable taxes.

One-Off Payment

• Commission is a one-off payment per student enrolment. You will not receive recurring commission on the same student's account. If a student upgrades to a higher tier or purchases a separate course, a new qualifying enrolment must be attributed to your Affiliate Link.

Qualifying Sale

A qualifying sale is defined as:

• A completed, paid enrolment in the Course

• Attributed to your Affiliate Link within the cookie window

• Not subsequently refunded or charged back

• Not a purchase made by you or any immediate family member

• Not a fraudulent or otherwise ineligible transaction

Payment

Payment Schedule

• Payments are processed on a monthly basis, on or around the 28th of each calendar month, for qualifying sales confirmed in the preceding month. LactationGO reserves the right to hold payment for up to 30 days following a sale to allow for the refund window to pass.

Payment Method

• Commission will be paid via bank transfer to the account details provided by you at the time of registration. It is your responsibility to ensure your payment details are kept up to date. LactationGO accepts no liability for misdirected payments resulting from incorrect information provided by you.

Currency

• All payments are made in Pounds Sterling (GBP) unless otherwise agreed in writing.

Taxes & Self-Assessment

• You are solely responsible for declaring commission income to HM Revenue & Customs (or the relevant tax authority in your country of residence) and paying any applicable income tax, National Insurance, or other taxes. LactationGO does not deduct tax at source and does not provide tax advice. If you are VAT-registered, you must notify us accordingly.
  

Affiliate Obligations

Accurate Representation

• You agree to promote the Course honestly, accurately, and in a manner consistent with LactationGO's brand values. You must not make claims about the Course that are false, misleading, or not substantiated by LactationGO's published materials.

Compliance with Law

• You must comply with all applicable laws and regulations, including but not limited to the UK Consumer Contracts Regulations, the ASA/CAP Code on advertising, GDPR, and any platform-specific terms of service (including Instagram, TikTok, Facebook, LinkedIn, and YouTube).

Disclosure of Affiliate Relationship

• You must clearly and prominently disclose your affiliate relationship whenever promoting the Course. This includes using language such as '#ad', '#affiliate', or 'I earn commission from this link' in accordance with ASA guidelines. Failure to disclose is a serious breach of this Agreement.

Prohibited Conduct

You must not:

•  Bid on LactationGO's branded keywords in paid search advertising

• Use your own Affiliate Link to purchase the Course yourself or for anyone in your household

•  Offer unauthorised discounts, cashback, or incentives to prospective students

• Spam, cold message, or use unsolicited bulk email to promote the Course

• Create fake reviews, testimonials, or social proof

•  Impersonate LactationGO or claim to be an official representative

•  Use cookie stuffing or other fraudulent tracking manipulation

•  Promote the Course on any adult, harmful, or illegal content platforms
  

Intellectual Property

• LactationGO grants you a limited, non-exclusive, revocable licence to use approved LactationGO branding, logos, and promotional materials solely for the purpose of promoting the Course under this Agreement. You must not alter, adapt, or modify any LactationGO materials without prior written consent.
  

• This Agreement does not transfer any intellectual property rights to you. All LactationGO course content, materials, branding, and trademarks remain the exclusive property of LactationGO.

Refunds & Chargebacks

• If a student receives a refund or initiates a chargeback, the corresponding commission will be deducted from your account. If this results in a negative balance, the shortfall will be offset against future earnings. LactationGO will notify you of any refunds affecting your commission balance. 

• LactationGO's student refund policy is available on our website and is subject to change.
  

Term & Termination

Duration

• This Agreement commences on the date your application is accepted and continues until terminated by either party.

Termination by You

• You may terminate your participation at any time by providing written notice to LactationGO at [email protected]. Commission earned on qualifying sales prior to termination will be paid in accordance with Section 5.

Termination by LactationGO

LactationGO may suspend or terminate your affiliate account immediately and without notice if you:

• Breach any term of this Agreement

• Engage in fraudulent, deceptive, or harmful conduct

• Bring LactationGO into disrepute

• Fail to generate any qualifying sales within any continuous 12-month period

• LactationGO may also terminate the Programme entirely at any time with 30 days' written notice to all affiliates.

Effect of Termination

• Upon termination, your Affiliate Link will be deactivated and you must cease all promotional activity. Any unpaid commission on qualifying sales completed before the termination date will be paid at the next scheduled payment date 

Limitation of Liability

• LactationGO's total liability to you under this Agreement shall not exceed the total commission paid to you in the three months preceding the event giving rise to the claim. 

• LactationGO shall not be liable for any indirect, consequential, or special loss, including loss of profit, loss of income, or reputational damage arising from your participation in the Programme.

• Nothing in this Agreement shall limit liability for fraud, death, or personal injury caused by negligence.

Amendments

• LactationGO reserves the right to amend these Terms and Conditions at any time. You will be notified of material changes by email to the address registered on your affiliate account. Continued participation in the Programme following notification constitutes your acceptance of the revised terms.

Governing Law

• This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
